Trademark Renewal Services In India

In the competitive Indian market, a trademark isn't a "one-and-done" achievement—it’s a long-term asset that requires maintenance. Under the Trade Marks Act, 1999, trademark rights are granted for a 10-year term from the original filing date. To keep your brand's shield active, you must navigate the renewal process before that decade lapses.

Missing a renewal doesn't just mean losing a certificate; it means leaving your brand’s reputation—and the customer trust you've built—vulnerable to competitors.

The Renewal Roadmap: Timing & Fees (2026)

A frequent question we hear is: "How often do I need to renew my trademark?"

The Rule: Your protection lasts for 10 years. You can initiate the renewal process as early as one year before the expiration date.

The Indian Trademark Registry operates in three distinct phases, each with specific costs per class:

1. The Standard Window (The "Safe Zone")

  • Timeline: 1 year before expiry.

  • Status: This is the best practice to ensure your legal rights continue without a single day of interruption.

  • Government Fee (E-filing): ₹9,000 per class.

2. The Grace Period (The "Penalty Zone")

  • Timeline: Up to 6 months after the expiry date.

  • The Cost: You must pay the standard renewal fee plus a surcharge of ₹4,500, totaling ₹13,500 per class for e-filing.

3. The Restoration Window (The "Emergency Zone")

  • Timeline: 6 months to 1 year after expiry.

  • The Process: Once the grace period ends, the Registrar officially "removes" your mark from the register. You have one final year from the original expiry date to apply for Restoration.

  • The Cost: This requires a restoration fee of ₹9,000 in addition to the renewal fee, totaling ₹18,000 per class for e-filing.

Pro Tip: There is no limit on how many times you can renew. As long as you file every 10 years, your trademark can legally last forever.

Why Timely Renewal is Non-Negotiable

  • Uninterrupted Monopoly: Renewal maintains your exclusive right to use the brand identity nationwide, preventing others from "squatting" on your name.

  • Preserving Goodwill: Your trademark is the face of your customer’s trust. Letting it lapse creates a gap in your legal history that competitors can exploit.

  • Avoiding Legal Headaches: It is much more cost-effective to renew a mark than to fight a legal battle to restore it or, worse, attempt to reclaim a name that a competitor has already applied for.

  • Financial Asset Value: A registered trademark is an intangible asset on your balance sheet. It can be sold, licensed, franchised, or used as collateral. An expired mark loses this commercial value instantly.
